Joe Biden has come under scrutiny after reports revealed that he used an autopen to sign numerous executive orders, raising concerns about his awareness and involvement in key decisions. The Heritage Foundation’s Oversight Project found that nearly all documents signed by Biden during his presidency bore identical autopen-generated signatures, except for his 2024 campaign withdrawal letter.
Critics, including Missouri Attorney General Andrew Bailey, argue that this could call the legitimacy of Biden’s executive actions into question. Bailey has demanded a Department of Justice investigation, claiming that unelected staff may have used Biden’s cognitive decline to push policies without his direct approval. He stated, “If true, these executive orders, pardons, and all other actions are unconstitutional and legally void.”

The use of autopen signatures is not unprecedented—past presidents like Barack Obama and George W. Bush have used the technology for certain documents. However, the scale of Biden’s use has drawn fresh concerns, especially given longstanding questions about his mental acuity. Critics claim that whoever controlled the autopen effectively controlled the presidency.
Biden’s team has not responded to the allegations, but the findings have reignited debate over his decision-making abilities in his final year in office. With Trump and other political figures weighing in, the controversy is likely to continue as further details emerge.
