Erik and Lyle Menendez could be released from prison on December 11, as their lawyers seek to reduce their murder convictions to manslaughter. A meeting with their defense team, the district attorney, and Judge Michael V. Jesic set the court date for a hearing. If the judge agrees to the change, the brothers would be released immediately, having already served more than three times the maximum sentence for manslaughter.
Additionally, L.A. County District Attorney George Gascón is asking for a resentencing to 50 years to life, making the brothers eligible for immediate parole. This process, however, would involve the parole board and could take several months to finalize. Alternatively, their attorney, Mark Geragos, is submitting a petition for clemency, which would require California Governor Gavin Newsom’s approval to commute their sentence.
There are multiple pathways to freedom, and it’s likely the Menendez brothers could be home for the holidays if the judge’s decision is favorable. However, if the judge delays his ruling, the timeline could extend.
